The un-Constitutional Lawyer

'Recent public comments by a senior Pentagon official showed a callous disregard for the principle of equal protection under the law. The remarks by Charles D. Stimson, deputy assistant secretary of defense for detainee affairs, were broadcast Thursday during an interview on Federal News Radio in Washington, D.C.

In that interview, Mr. Stimson expressed dismay that an estimated 500 lawyers have volunteered to represent detainees at Guantanamo Bay in federal court. A syndicated talk-show host is seeking the release of the names of the lawyers and their firms under the federal Freedom of Information Act.

"I think, quite honestly, when corporate CEOs see that those firms are representing the very terrorists who hit their bottom line back in 2001, those CEOs are going to make those law firms choose between representing terrorists or representing reputable firms ... be fun to watch that play out," he said.' Mr. Stimson has NO right to threaten anyone who offers pro-bono service to provide legal representation to these defendants. The only way for the legal process to proceed and these defendants to be found guilty or not guilty is if they are offered legal representation. This is a basic tenant of our society. If the Pentagon has good reason for these individuals to be detained, then they have nothing to worry about from any lawyer. Mr. Stimson seems afraid of something and one has to wonder what that is.

Most disturbing, however, is Mr. Stimson's attempts at threatening private citizens of the United States and using the government bully-pulpit to do so. This administration continues to show it's hatred and disgust for the people of the United States and it's continuing dictatorial attitudes towards the very freedoms that make this country great. Mr. Stimson is un-American and un-Patriotic and he should be fired from his position.

On Wednesday, the Washington Post printed a letter to the editor from Stimson in which he apologetically flip-flopped, "Regrettably, my comments left the impression that I question the integrity of those engaged in the zealous defense of detainees in Guantanamo. I do not. I believe firmly that a foundational principle of our legal system is that the system works best when both sides are represented by competent legal counsel."

This statement proves even more that Stimson should be fired. Apparently the connection between his brain and his mouth is irreparably broken. No lawyer in his high position should have to be reminded of the meaning of the United States Constitution. It's hard to imagine how Mr. Stimson even passed the Bar Exam. Mr. Stimson should not only be fired; he should be disbarred.
